Software Disclaimer & User Responsibility Agreement

This Software Disclaimer, Limitation of Liability, and User Responsibility Agreement (this "Agreement") is entered into by and between XDRIP Digital Management, LLC ("XDRIP," "Company," "we," "us," or "our"), and each individual or entity that downloads, installs, accesses, or otherwise uses the XVaultPro password vault software and any associated modules, features, protocols, or tools (collectively, the "Software").

If you do not agree to all of the terms and conditions of this Agreement, you must immediately cease all use of the Software and delete all copies in your possession or control.

1. Not Financial, Investment, or Custodial Advice

Nothing contained in or provided through the Software, our website, documentation, marketing materials, or any communications from XDRIP shall be construed as financial advice, investment advice, legal advice, tax advice, or custodial services of any kind. XVaultPro is a self-custody password management tool — it does not manage, hold, control, insure, or guarantee any funds, assets, or stored credentials.

2. Software Provided "As Is" and "As Available"

The Software is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, XDRIP expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing, usage, or trade practice.

While XDRIP employs industry-leading security practices and continuously works to improve the Software, no software system, regardless of its design, architecture, or implementation, can guarantee absolute security against all possible threats at all times.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XDRIP PARTIES BE LIABLE FOR:

• (a) Any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to damages for loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings;
• (b) Any loss, theft, unauthorized disclosure, or corruption of stored credentials, vault contents, or other items of value stored, managed, or transacted through the Software;
• (c) Any unauthorized access to, alteration of, disclosure of, or loss of your data, master password, TOTP secrets, or any other credentials;
• (d) Any damages resulting from third-party actions, malware, phishing, operating system vulnerabilities, or law enforcement actions.

4. Aggregate Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW: The total aggregate liability of XDRIP Digital Management LLC for all claims arising out of or in connection with this Agreement shall not exceed the greater of:

• Total fees paid by you during the twelve (12) months preceding the claim; or
• One hundred United States dollars (USD $100.00)

5. Third-Party Integration Disclaimers

The Software may interact with or depend upon third-party services, operating system APIs, and infrastructure that are not owned or controlled by XDRIP ("Third-Party Infrastructure"). XDRIP makes no representations or warranties regarding Third-Party Infrastructure and shall not be liable for any loss or damage arising from:

• Third-party API outages, vulnerabilities, or data breaches
• Changes to third-party terms of service or discontinuation of services
• Operating system vulnerabilities or updates that affect Software compatibility
• Device hardware defects or compromises
